Development Authority
Keep your eyes and ears open regarding any new
industrial development rules or regulations that will be
put into place via the BLB Industrial Development
Authority.

The Mayor of BLB previously appointed four additional
board members; Walton Kraver, Greg Marshall, Bud
Robertson and Jeff Younce.   The initial board members
were Cleveland Rodriquez, Billy Ladnier and Terry Sue
Smith.

Got Questions?  Maybe you should.  This board will have
a major impact on future business's coming into the
area and may create changes to how existing
companies interact with the city that are within BLB's
jurisdiction.

At the first meeting of this Authority MOBAY presented
their request for tax abatements on their upcoming
project(s) totaling approx. 455 million.  Tax
abatements can only be granted through the County,
a Municipality or an Industrial Development Board.  I
am sure that MOBAY is unaware of the picture their
presentation at the very first meeting creates.
MOBAY's facility is not located in the corporate limits
of the City of Bayou La Batre therefore abatements
could not be made through the Municipality.

The board also requested from the City Council
approval to hire an attorney for clarification and
exposure to legal matters.  At the May 7, BLB Work
Session, the Mayor made the statement that since
MOBAY requested the tax abatements then he would
have them pay for the attorney for the board's
counsel.  In very poor english my personal opinion is
"
that don't look too good".
In addition to the board
member's listed, the city's
inspector, Tommy Reynoso
was placed on the board to
represent the city.  He was
also named secretary and
treasurer.

Any funds or property made
available to this Authority will
be funneled through the City
of Bayou La Batre.
Is it legal for an employee of a municipality to have a position on an Industrial
Development Board?
Maybe the city's attorney should check into that.
or,
Maybe Councilman Barnes could help out a bit, he brings several important legal factors
to light on occasion, must be all that reading he does while squeezing the charmin.  
Highlights of the May 14th Bayou La Batre City Council meeting included:

Ordinance No. 2007-585, Re-Zone Property at 8760 Little River Road, From R-1 to B-2 upon the
condition that the only permitted use to be allowed on the property is office use only.
By vote of the City Council -  NOT PASSED  - This property will not be rezoned.

Our hats off to Councilwoman Debi Downey for sticking to her guns on this issue.   A woman with her own
mind offers an invaluable service to her municipality.  The residents applaud the fairness of both you and
Councilwoman Ida Coleman.
  

Approve to Abate properties as recommended by the Housing and Abatement Board at the following
addresses:

The fact that several properties belonging to Mr. Ira Johnson on Adams Street was not listed was a notable
highlight.  At the work session prior to this council meeting the Council was challenged to prove that
these parcels were indeed annexed into the city of BLB.  The city's attorney provided ordinances and
letter references from the Justice Department regarding these parcels yet when we requested these
documents from City Hall they were never provided.  One can only assume that they do not exist or that
maybe there was an oversight in the city's legal representation of this matter.  

If you feel you have property that was not legally annexed into the City of BLB and you have pending
abatement issues with the city's abatement board and inspection department, please challenge the city to
provide you with the ordinance and related signed documents regarding the annexation of your property.  
The BLB Abatement Board does not have jurisdiction outside the corporate limits and cannot demand that
you tear down your dwelling if you are outside it's jurisdiction.

Congrats to Mr. Ira Johnson for reclaiming your property rights within the County.

At the request of the Mayor, the council went into executive session to discuss pending litigation.

Upon return the Mayor requested that the city council support his recommendation that the city of BLB
pursue legal action against bayou-coden-info.com for defamation of character.

There was hesitation after the Mayor asked for a motion, but as usual, the three attending council
members obliged the Mayor in his recommendation.

BLB City Council Meeting May 31, 2007 - 6:00pm
It was to be expected that Greg Marshall, owner of 8760
Little River Road, approached the council with his
objections to the recent decision for denial of re-zone from
R-1 to B-2.  Mr. Marshall was lacking in his case to have the
property reconsidered because of several steps that he
failed to take during the reconstruction of this property.  
The phrase "the permits were waived" seems to be a
frequent response from property owners with a variety of
problems involving the city's inspection department,
abatement board and planning board.  Either a lack of
understanding or just misinformation, more than just a few
property owners have fell victim to not having permits to
complete work on their construction projects or have
encountered severe problems in the aftermath.  Each time
this issue has arisen the city's response has been "the
fee's were waived but not the permits".  Common sense
has made property owner's question the permit's waived
comment but when a city representative tells you that you
do not need a permit the ordinary citizen does not feel it is
within their power to demand issuance of a permit.  This
has left many land owners in a state of limbo with no easy
answer to the future of their reconstruction efforts.  This
does however afford the city multiple avenues of which to
demand the property owner to comply with it's current
strategic plan.  Even though this property was not
re-zoned in consideration of the surrounding residential
community, the non-permitting issue was of grave concern
to the council at large.  If beginning or even completing a
construction project within the Bayou La Batre corporate
limits you are required to comply with all permitting rules
and regulations of which you may obtain at City Hall.  If
someone should lead you to believe that a permit is not
required, it is your right to question their credentials
and/or contact their superior for confirmation that a permit
is not required.  And then you might want to get that in
writing!

We are proud to be able to keep citizens of
the area informed on local news and policy.
The meeting took a surprise turn in closure by voting
unanimously to invoke a stop work order to the
contractor erecting a warehouse on the end of Tapia
street.  This property belongs to Greg Marshall of
Marshall Marine.  Councilman Barnes relayed to the
Council that the Planning Board had raised concerns at
their meeting earlier in the day about not receiving a site
plan for this property.  The stop work order is to be in
effect until Mr. Marshall submits a site plan to the
Planning Board for review as would be required for any
new construction in the corporate limits.
Mayor Wright allowed Ms. Leila Collier to voice her
opinion of the proposed zoning of 8760 LIttle River Road
that was defeated at a previous council meeting.  The
Mayor mentioned that Doug Cagle of MOBAY had
contacted him requesting to allow Mrs. Leila to speak.  
The Mayor was accommodating.  Councilman Barnes
spoke up to educate the council and the public that per
prior ordinance invoked by the city, there would have to
be a 12 month waiting period before reconsideration of
this property re-zone could occur.  Sorry guys - it's a
no-go on that MOBAY property issue.  As many times as
this issue has come about in the past several weeks, one
would almost think that the assumption would be to just
let them re-zone it so we don't have to hear about it
anymore but standing strong is councilwomen Ida
Coleman and Debi Downey who are standing behind their
"I have said no" decisions.  Great job ladies.

The mayor, grant writer and select others made it back
from Washington after receiving the 16 million dollars for
new housing.  The mayor was praised by the grant writer
for his excellent behavior and also in helping to obtain
another grant possibility for 5 million to go forward with
the new WWTP.  Even though the grant is contingent on
matching funds and the utility board is not willing to
accept a debt of 1.75 million to match these funds, the
city is stepping in to float a bond for the additional
money.   That means the city will be in additional debt for
the 1.75 mil.  It was mentioned that grant money for the
new housing sewer hookups (impact fees) will be
adequate to cover the new debt.  As it stands, the city is
basing all new and current developmental strategies on
existing and future grant possibilities.  One can only
hope their grant writer doesn't take any extended
vacations.
A letter was sent into the city praising the inspection
department and their work with a new home owner.  
Proof that #1 - miracles do exist and #2 - that
select home
owners have no problem with receiving permits for new
construction.  Good job guys!  The city is in need of
whatever constitutes revenue - even a couple of permit
fees.
BLB City Council Work Session June 18 - 6:00pm
Come on now, play nice!
The city's building inspector, Tommy Reynoso, wrote a
letter to the Mobile County Personnel Board claiming he
has been harassed by a couple of council members.  
Evidently, they are upsetting his routine and he is now
expected to do his job - whatever that may be.  The letter
was read aloud by the city's attorney so I guess Mr.
Reynoso knows that we were all listening to the story of his
plight.  In consideration thereof, our sincerest regrets that
you have been subjected to such monumental problems
that have hindered your job performance.  Surely there is a
position as garbage truck driver.  The city may need a bully
to collect their cans or turn off the water to those
delinquents that refuse to pay for the pickup.   Back to the
matter at hand, to let you know Mr. Reynoso we do not
make light of your seemingly childish allegations - and by
the way, the two members of the council did not look to
happy either.

Wouldn't it had just been
easier to give the site plans
to the Planning Board?
Approximately 160,000 was
moved from the Bush/Clinton
Boat Removal fund to the BLB
general account even though the
boat removal process ended last
year and excess monies should
have been returned.  Upcoming
audit of this account in July
should prove to be pretty
interesting.

The mayor has commented on
several occasions that he is all
for accountability.  I agree, lets
have some!

So hey dude, I bet if we have our
picture taken with the president
he won't mind us keeping the rest
of that money.  Maybe the city
could pave some of Little River
Road with it.  Or better yet, if
there is any of that gas tax
money left you could use that.  I
hear that's what it's suppose be
used for.

 About That Letter
The city's attorney apologized for reading the Reynoso letter
aloud at the previous work session.  No harm done.  I'm sure
the Mayor was inclined to accept your apology.

The city brought in all their finest to hear praises for a great job
during recent drug busts.  Again and again guys we do thank you
for your efforts in controlling the crime population. Fancy that the
Librarian chose the close of this meeting to publicly bring rumors
to the Council's attention (Robert's Rules of Order attached for
your reference dear) inquiring of Councilman Barnes if he was
plotting to have the police chief dismissed.  Well if he was do you
think he would have told you with all those cops standing in the
back of the room?  Sometimes we need to think before we speak.
So for all your gossip needs head on out to the city's brand new
library.  They have plenty! Maybe they could open on Saturday so
the parents can make it with the kids to learn something new.

Saturday the Mayor made some "not
so quick witted" statements in public
that embarrassed a few people from
the area.  Upon looking into his
comments, I can see where one would
wonder about his strange sense of
humor at a memorial service.
Anyone in our area interested in the
Environmental Assessment for the ongoing
redevelopment process, especially those
regarding the proposed  placement of the new
WWTP should read this document.   Our time
to stop this environmental catastrophe is
running short!  Don't wait for a
self explanatory
public notice, it's not going to happen.

This is a draft so now is the time to make our
opinions known to FEMA.  It is our right and
our responsibility.

For those whose interest are in why Coden and the surrounding area are upset with Bayou La Batre for their
efforts in placing a WWTP within a coastal flood zone, this is why.

Thanks B. Reid for your explanation.                                         (DEA - Draft Environmental Assessment)

I interject no objection to the funding of the development of the proposed community housing projects but have
serious objections to the DEA and placement of the proposed relocated wastewater treatment plant. These
objections are based upon the following:

1) Lack of Notice of DEA/ Lack of Ability to Comment. Although I am an effected landowner, I have received no
notice of the DEA nor the public comment period. My first notice was during the week of January 14th, 2008 via
email from a third party. I have repeatedly requested notice from various agencies and my interest in this matter is
known to the Bayou la Batre City Council and Mayor, Attorneys for the City of Bayou La Batre and Bayou La Batre
Utilities Board. Also given that many who live in the immediate area do not speak English as a first language, I am
advised that they have not received adequate notice either. As this matter has an adverse impact upon my
property, the dictates of due process mandate adequate notice to myself and those similarly situated.

2) Placement of the RWWTP within the floodplain in a coastal high hazard zone when other alternatives exist. The
purpose and intent of the project is defeated by funding the RWWTP and creates great potential for future
environmental harm due to weather related hazards and sewer overflow. Pursuant to the DEA , the stated
purpose and intent of the proposed project is to relocate the waste water treatment plant out of the coastal high
hazard zone to alleviate the risk from future storm damage and subsequent sewer overflows (DEA Section 3.5.2) .
The proposed new site located at 14575 Railroad Street is just as vulnerable to flooding , storm surges and
contributing to sewer overflows as the current location at 285 State Docks Rd. Section 4.3.22 of the DEA notes
that “The new WWTP is located within FEMA floodplain designated zone AE, within the 100-year floodplain. The
lift station would be built in the location of the existing WWTP, which is located in the coastal high hazard area
(FEMA floodplain designated zone VE) within the 100-year flood plain). In addition, the new influent/effluent lines
would also be constructed within FEMA floodplain designated zones VE and AE (FEMA, 1998).”

hope that FEMA does not
hear about the comment
that the Mayor sat back in
his chair at home and
thought about before he
made, they might
consider taking back all
those millions of dollars
that have gone to restore
the city so far.  Some
think that it is sites like
this that is his enemy but
so far I can only see one
enemy of the Mayor and
that is himself.  
FEMA and Millions, Plots and Plans, No Public Comments so
No Action Necessary,
We will have what we want because we know how...
